Please read our terms and conditions carefully. By purchasing products from this website we will assume that you have understood and accepted them. These terms and conditions (“Terms of Use”) are in addition to our privacy policy and our returns policy.  We reserve the right to change the Terms and Conditions at any time and it is your responsibility to check regularly before ordering.  This does not affect your statutory rights.

Terms of Service

These Terms of Use apply to the purchasing of goods from Nite International Limited and it’s Licensee(s) available through nitewatches.com  (the “Services”). These “Terms of Use” govern the relationship between you (the consumer) and us when you access and use the Services (the “Agreement”). By placing an order via our website (www.nitewatches.com), you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Delivery information below for further information.

In order to contract with Nite International Limited and its Licensee(s) you must be over 18 years of age. Nite International Limited and its Licensee(s) retains the right to refuse any request made by you. If your order is accepted, we will inform you by email. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card, or bank account used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of international products and services may fluctuate. All prices advertised are subject to such changes.

About You

You confirm that You are over 18 and the valid holder and owner of any credit or debit card used during Services. We reserve the right to refuse your order at our discretion.

Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. Nite International Limited and its Licensee(s) retain the right to accept or reject this offer before processing the order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us, the prices have been verified, and the order has been processed and dispatched. A second email will be sent confirming these arrangements.

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Grand Total’ field at the checkout.

The website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfil any orders that you may place based on information on the website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

Order Process

Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

When placing an order, you must provide a valid e-mail address and contact telephone number. Failure to provide this information will lead to the cancellation of your order.

When you purchase Products from our Website, and you have pressed the “Complete Your Order” button we shall confirm your Order via email and assign you with an order number via email to confirm your purchase. This email is NOT an acceptance of your Order, just a confirmation that we have received it (“Order Confirmation”). The Order Confirmation will confirm the following: a description of the Products ordered; the total price of the goods; the applicable delivery charges.

The contract between us will only be formed when we send you the “Dispatch Confirmation”. The Dispatch Confirmation is the email that we send to you when we have accepted your Order and it will be sent to you on dispatch to you of your Order (unless we have been unable to fulfill your Order or if you have cancelled the Order beforehand).

If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order.

Payment

Payment over the Internet can be made via our secure checkout page using MasterCard, Visa, Barclaycard, Maestro, Solo and PayPal.You can also pay using PayPal. Card charges will appear on your statement as “NITE INTERNATIONAL LTD”.

Nite International Limited is VAT registered and our VAT number is 928 8201 10.

All prices are quoted in US Dollars ($) and do not include Value Added Tax (VAT) at UK rates. It may be necessary to adjust prices in the event of a manufacturer price increase. Customers are entitled to a full refund if this is not acceptable.

Due to the nature of the clearing system your card payment will be taken at the point of processing – when You click “Complete Your Order”. If a problem in supply should occur, your payment method will be refunded as swiftly as possible.  The refund may take a couple of days to show as cleared funds on your account, depending on payment provider.

You confirm that the debit/credit card or other payment method that is being used is yours. All debit/credit card holders and payment accounts are subject to validation checks and authorization by the card issuer and/or payment processor.  If the issuer of your card and/or payment processor refuses to authorize the payment or does not accept liability against fraudulent use, we will not accept your order and we will not be responsible for any delay or non-delivery.

We are not obliged to inform you of the reason for the refusal of an order. We are not responsible for your card issuer, bank or payment account charging you for processing your payment in accordance with your order.

If your delivery address is outside of the UK, you may be required to pay import duties and taxes when your order reaches your country. These and any additional charges for customs clearance are your responsibility. All orders are fulfilled and dispatched from UK.

Our Products

The images of the Products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflects the actual colour of the Products. Your Products may vary slightly from those images.

Delivery

Delivery is free on all items!

The estimated delivery period is as follows:You will normally receive two emails from us in the form of a confirmation of receipt of order and payment followed by notification of dispatch of goods. Once an order and payment has been processed, goods will be shipped by our nominated Courier within 48 hours. Please note that our offices are closed on Saturdays and Sundays therefore orders placed during this time may take up to 72 hours to be dispatched, this includes orders after 12:00 on Fridays.

USA DHL: 3 – 7 days
USA Royal Mail: 7 – 21 days
Rest of World DHL: 3 – 14 days
Rest of World Royal Mail: 3 – 21 days

We will make every effort to deliver your order within the above time-scales. However, this is a guideline and delivery cannot be guaranteed. We will not accept responsibility for delays caused by our Couriers or any National postal service. If the goods are not delivered within the time we have estimated, please feel free to contact us by telephone  +44 (0)1202 487757  or email sales@nitewatches.com and we will do everything possible to resolve the issue promptly. We will not be liable for any loss caused to you by late delivery. It is the responsibility of the purchaser to pay all subsequent import tax and duty on goods shipped to their respective Country. In the instance that items are returned to Nite International Limited and it’s Licensee(s) as a result of a rejected payment, subsequent charges incurred such as Import Duty and processing costs will be deducted from any refund issued. We do not accept any liability for goods that have been lost after delivery to a PO Box. We reserve the right to cancel orders where the delivery address is a PO Box. We also do not accept any liability for goods that have been lost after delivery to the Army Post Office and Fleet Post Office sorting offices. It is the Customers responsibility to notify us if the goods have not been received within 21 days of the estimated delivery date or receipt of our invoice. If no notification is made within this time period the buyer shall be deemed to have received the goods.

 

Returns Policy

Returns, refunds & exchanges

If your watch is within the 28 day returns guarantee period then you can return your order to us for an exchange or full refund. For instructions on returning products to Nite please email sales@nitewatches.com.

All return periods being from the date you receive the goods. Items which have been worn or display signs of wear are unable to be returned for a full refund – this does not affect your statutory rights.

Customised watches are excluded from our returns policy.

We recommend that Item(s) being returned should be sent using a registered and insured postal service such as DHL or USPS. You are responsible for fully shipping and insuring the returned goods to us. We do not accept liability for any loss or damage of returned goods during transit. Claims for lost goods shipped by You must be dealt with by You as the sender.

If you would like to return your purchase for an exchange then we will send your replacement to the original delivery address.

Any refund will automatically be issued to the payment method you used to place your original order. This typically takes 5 – 10 working days depending on your payment method issuer.

Faulty products

Our products are packaged safely and securely to ensure they arrive in perfect condition. However, goods in transit can sometimes be subject to damage and may arrive in an unsatisfactory condition. In the unlikely event of this occurrence, please take a photograph of the damage and email this to sales@nitewatches.com

After we have received and inspected the returned item, we will replace it free of charge. Should a refund be requested, then a refund will be made within 14 days of receipt. In these circumstances we will also pay you the cost of the return postage to an upper limit of $15.00.

Please obtain proof of posting certificate from your Post Office to enable us to process the refund for your return postage costs. This does not affect your Statutory Rights. It is important and a requirement that when returning goods from overseas you complete a customs declaration form as “returned unwanted goods with zero value”. Nite International Limited and it’s Licensee(s) does not accept any liability for subsequent charges incurred such as Import Duty and processing costs due to inadequate marking of the returned package.

Your Rights and Agreements

You agree to use the Services only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Services by any third party. You agree to comply with these Terms of Use when using our Services and all applicable laws and regulations, together with any specific usage rules that may be posted in relation to any material and content that You access via the Services. The contents of the Services provided to You by us may not be copied, reproduced, communicated and/or made available to the public, republished, downloaded, posted, recorded, broadcast or transmitted or used in any other way, except for Your own personal, private and non-commercial use, unless otherwise expressly permitted by us. You agree that You will not use the Services in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity, or cause distress, harm or inconvenience to any other person. You will not do anything that may cause damage to the Services or our servers, systems or equipment or those of third parties, nor access or attempt to access any users’ data or to penetrate or attempt to penetrate the Services’ security measures. You agree to compensate us in respect of any damages suffered by us or any of our losses resulting from any claim made by a third party in each case in respect of any matter arising from Your use of the Services in breach of these Terms of Use or from Your violation of any applicable law or regulation. You agree not to give any indication that You have any commercial relationship with us, or that You are our agent. We reserve the right to suspend, restrict or terminate Your access to any or all of our Services at any time at our sole discretion if we consider You are or may be in breach of these Terms of Use. We may terminate this Agreement with You by giving You reasonable notice via E-Mail or in writing.

Intellectual Property

All intellectual property rights on the Services and all material or content made available by Nite International Limited and it’s Licensee(s) via the Services shall remain at all times the property of Nite International Limited and it’s Licensee(s). The names, images and logos identifying us, Nite International Limited and it’s Licensee(s), our partners or third parties and our/their products and services contained in the Services are proprietary marks and may not be reproduced or otherwise used without express permission. Nothing contained in these Terms of Use shall be construed as conferring by implication any licence or right to use any trade mark, patent, design right or copyright of Nite International Limited and it’s Licensee(s) or of any third party.

Links to Other Sites and Services

The Services may contain links to other third party sites and services through advertising or otherwise. These links are provided for Your ease of reference and convenience only. We have no control over those third party sites or services and are not responsible for their contents. We do not endorse the material contained in their sites or services, and have no association with their operators.

You agree that we won’t be party to any transaction or contract with a third party that You may enter into and we won’t be liable to You for any loss or damage which You may suffer by using those third party sites and services. You agree that You will not involve Nite International Limited and it’s Licensee(s) in any dispute You may have with such third party sites and services.

User Instructions and Presentations

The films, animations, diagrams and images presented in the Services are provided for Your advice and instruction only. We do not accept liability for any misunderstanding or misrepresentation of these articles neither do we accept liability for any damage caused by You to Your product or to Yourself as a result of acting upon these instructions.

Our Legal Obligations and Limits On Liability

Nothing in these Terms of Use will restrict Your statutory rights (including Your rights to receive a reasonable standard of service, more details about which can be obtained from Your local Trading Standards Office or Citizen’s Advice Bureau); or limit our liability for death or personal injury resulting from our negligence or for fraud.

These Terms of Use shall not make us responsible for any damage or loss caused to You where such damage or loss is not reasonably foreseeable to You and us when You agree to these Terms of Use (which occurs automatically when You access and continue to use the Services), including where the damage or loss results from our breach of these Terms of Use. We do not accept liability for any damage or loss caused to You where You are not entering into these Terms of Use as a consumer.

The Waste Electrical and Electronic Equipment Regulations (WEEE Regulations)

The Waste Electrical and Electronic Equipment Regulations are now part of UK law. The UK has agreed to reduce the amount of WEEE that is being disposed of in landfill sites.

It is important that the amount of WEEE sent to landfill sites is reduced because:

Some WEEE can be re-used or recycled. The amount of landfill space available in the UK is decreasing. If we can keep WEEE out of landfill sites it means there is more landfill space available for non-recyclable waste.

WEEE can contain hazardous substances. When left in landfill sites the hazardous substances in WEEE can pollute soil and contaminate water supplies. This contamination can damage human health and the environment.

Distributors of new Electric and Electronic Equipment (or EEE) have a part to play in reducing the amount of WEEE going into landfill sites.

Nite International Limited and it’s Licensee(s) is observing these regulations by offering our customers free take-back of their WEEE on a like-for-like basis when they purchase a battery operated or electronic product.

For example, if a customer buys a new battery operated watch from us we will take back their old watch (provided it is of equivalent type and function) and prevent it going into a landfill site by disposing of it safely. Customers must return their old WEEE within 28 days of purchasing their new item. Customers do not have to pay to return their old item to us.

Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol shown below.

Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste.

Important Terms

The Terms of Use supersede any other terms and conditions for use of this website previously published by us.

These Terms of Use are available in English only and shall be governed by and construed in accordance with the laws of England (or the laws of Scotland if You are domiciled there). Disputes arising in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of England and Wales unless You choose the jurisdiction of Your domicile in Scotland or Northern Ireland.

Communication and Marketing

If you have made a purchase from our store we may occasionally update you via email about our latest products, news, special offers and customer feedback surveys.

You will also be given the opportunity to receive such communications from us when you become a member of UNITE.

If you do not wish to continue to receive email communications from us you will always be able to opt-out by clicking on the “unsubscribe” link that will be present on any email that we send you.

Nite International Limited and it’s Licensee(s) will undertake to handle complaints fairly and competently. We will keep you informed either by telephone or email at each stage and will endeavor to fully resolve your complaint within 72 hours.
